Where are these individuals supposed to go when it’s not severe weather?
Outside of severe weather, unhoused individuals in Loveland currently have no guaranteed shelter options. The city closed its only full-time overnight shelter (SRF) on September 30, 2025, and has not established a permanent replacement.
🏚️ Current Shelter Landscape in Loveland
- South Railroad Facility (SRF): Closed permanently after a failed 4–4 council vote to extend its permit. No extension is legally possible under city code.
- Loveland Resource Center (LRC): Only activates as an emergency overnight shelter during severe weather. Outside those conditions, it operates as a daytime resource hub (Mon–Fri, 8 a.m.–5 p.m.).
- No designated camping areas: The city explicitly states that it cannot create sanctioned encampments due to staffing and funding limitations.
- City Hall (temporary refuge): Mayor Jacki Marsh opened City Hall to unhoused individuals during a cold, rainy night in early October, but this was an unsanctioned, one-time emergency gesture—not a sustainable solution.
🚫 Legal & Enforcement Constraints
- Encampment Ban Enforcement: Under Martin v. Boise, Loveland cannot enforce its encampment ban unless shelter space is available and offered. Without shelter, enforcement is legally restricted.
- Trespassing Ordinance: Used selectively to prohibit camping on closed or misused public property. This ordinance does not replace the need for shelter and is enforced case-by-case.
🧭 Where Do People Go?
- Public spaces: Many individuals have resorted to sleeping in parks, ditches, or outside City Hall. These locations are vulnerable to enforcement and lack basic safety.
- Faith-based or nonprofit aid: Some churches and local groups offer limited support, but there is no coordinated or city-sanctioned overnight shelter system.
- Neighboring cities: Some may travel to Fort Collins or Greeley for shelter, though transportation and eligibility barriers exist.
